Trout Days Fly Fishing - Guided Trip Indemnity Statement - Waiver of Liability
- Risks Associated with Guided Fly Fishing -
Trout Days Fly Fishing provides tuition and guidance in the sport of fly fishing. Although fly fishing generally carries a low level of risk, there are potential hazards when participating in outdoor activities, whether on the water or in the Australian bush. These include, but are not limited to:
1. Flies and Hooks: Fishing flies are sharp and constructed on barbed or barbless hooks that can cause injury. Eye protection (preferably polarised sunglasses) must be worn at all times when handling or casting. For health reasons, sunglasses are not supplied, and you must bring your own.
2. Uneven or Hazardous Terrain: Fishing locations may involve bushwalking, traversing mountainous areas or farmland, wading, or crossing rivers. Wear suitable footwear such as hiking boots or wading boots with thick socks. Gumboots are not recommended. Wading can be dangerous. If you feel unsafe or unsure, notify your guide immediately.
3. Venomous Wildlife: The Australian bush is home to snakes, spiders, and other venomous
creatures. Wearing waders, sturdy footwear, long pants, and staying alert reduces risk. Do not
attempt to touch or disturb any wildlife.
4. Sun Exposure: Sunburn risk is high around water, even in cloudy conditions. Follow Cancer Council recommendations and bring your own sun protection (Hat, Sunglasses, Buff, Sunscreen etc).
5. Alcohol Prohibition: No alcohol is permitted on guided trips. All participants must arrive and remain sober throughout the activity.
6. Medical Disclosure: All participants must complete and submit the required medical declaration before their trip and disclose any known or suspected medical condition, allergy and/or dietary requirement.
7. Food and beverage: a. Trout Days Fly Fishing takes all necessary precautions to ensure food safety standards and safe food handling guidelines are followed including necessary temperature control through the use of 12v fridge/freezers, 12v ovens and esky/cooler boxes.
b. food and beverages provided by Trout Days Fly Fishing will be store bought pre-packaged items. Trout Days Fly Fishing takes no responsibility for food or beverage items supplied by the client/customer.
7. Physical Strain: Casting, bending and crouching may cause muscle strain or injury, especially to the back and legs. Monitor your physical comfort and notify your guide if you feel at risk of injury. Bring appropriate clothing to stay warm if you cease fishing.
8. Appropriate Clothing: Always bring clothing suitable to current weather conditions including a hat. Have warm, weatherproof clothing available should the conditions change. Waders may be available on request. Neutral or bush-coloured clothing is recommended. Consider carrying a complete change of clothes in case of immersion. Trout Days Fly Fishing will not provide any clothing items.
9. Fishing Licence Requirement: A valid Victorian fishing licence is mandatory. You are
responsible for obtaining this before the trip. Licences can be purchased online via:
10. Raft Safety: For any raft-based service, life jackets (provided by Trout Days Fly Fishing) must be worn at all times without exception.
Additional Terms and Conditions
a. A non-refundable deposit of 50% of the total trip fee is required to be paid at the time of booking. The balance owning is due 14 days prior to your scheduled booking date.
b. Cancellations made more than 14 days prior to your trip date will forfeit the deposit paid; however, the deposit can be transferred to another suitable date within the same fishing season if available.
c. Cancellations made within 14 days of your trip date will forfeit the total trip fee paid; however, the trip fee can be transferred to another suitable date within the same fishing season if available.
d. Any bookings made within 14 days of the trip date require full payment at the time of booking.
e. Guided trip costs are set in advance based on participant numbers, trip type, location, and
duration.
f. Any transport that is provided between the ‘meeting point' and any fishing location is provided solely as a complimentary courtesy to clients and forms no part of the fee charged for guiding, tuition, or any other component of Trout Days Fly Fishing services.
g. Lunch and/or snacks and drinks are included in the agreed rate unless otherwise specified.
h. Fishing gear can be supplied by the guide if required.
i. All equipment is provided on a “replace if lost or broken” basis. Rod breakages incur a $75 fee per incident.
j. Trips are not cancelled for ordinary wind or rain. If weather conditions are deemed unsafe or
unfishable by Trout Days Fly Fishing, Trout Days Fly Fishing will contact you to rearrange or refund your booking.
k. Some trips take place on private property. Booking a guided trip does not grant future access to that property.
l. 'Catch and Release' fishing and safe fish handling is mandatory in all streams.
m. Minimum age for children on any trip is 12 years old. A parent or guardian is required to witness and sign this waiver on behalf of the child for participation.
n. Signing this waiver is a requirement for each client/customer prior to any trip commencing.
Client Acknowledgement of Risk and Waiver of Liability
(Required for participation in any guided Trout Days Fly Fishing Trip/Experience)

I confirm that I (referred to as the client or customer) have carefully read all details and information relating to the guided trip that I have chosen before making any booking. I have advised Trout Days Fly Fishing of any medical conditions, allergies, or dietary requirements I have, and I will carry any personal medication that I may require during the trip.
I understand that all personal information I provide will remain strictly confidential.
By agreeing to participate in a guided fly fishing trip or fly fishing course (referred to as the “guided trip”), I release and indemnify Trout Days Fly Fishing and its guides from any claims, liabilities, damages, costs, or expenses that may arise from injury, loss, or harm suffered during or as a result of the guided trip. This applies whether the cause is negligence by any person or any other factor.
By signing or providing my full name and 'I agree' in the guided trip booking form, I confirm that I have read and understand the above information and accept full responsibility for my own safety and the safety of any child in my care whilst on a guided trip. I understand that if I have any doubts about my ability to accept these risks and responsibilities, then I should not proceed with the booking.
